These Terms of Use (“Terms of Use” or “Terms”) govern your use of this Website (the “Website”) and any other related services provided by Audere, a nonprofit corporation (“Audere”, “we”, “our”, or “us”).  PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING OUR WEBSITE.

These Terms of Use describe the legally binding terms and conditions that oversee your use of the Website. BY LOGGING INTO AND/OR USING THE SITE, YOU AGREE TO COMPLY WITH THESE TERMS and you represent that you have the authority and capacity to enter into these Terms. YOU SHOULD BE AT LEAST 18 YEARS OF AGE TO ACCESS THE SITE. IF YOU DO NOT AGREE WITH THE PROVISION OF THESE TERMS, DO NOT LOG INTO AND/OR USE THE SITE.

You grant Audere and our service providers the right to use your information as described in the Privacy Policy. This Website is offered and available to users who are 18 years of age or older and reside in the United States. By using this Website, you represent and warrant that you are of legal age to form a binding contract with Audere and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

The Website may contain links to third party Websites. Audere is not responsible for the content of such third party Websites, including Websites framed within the Website. If you elect to use such third party Websites, your use is at your own risk and is subject to the terms and conditions of use for such Websites.

IN NO EVENT WILL AUDERE OR ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LICENSORS, PHYSICIANS, HEALTHCARE PROVIDERS OR SERVICE PROVIDERS  BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE ARISING OUT OF OR IN ANY WAY CONNECTED WITH ACCESS TO OR USE OF WEBSITE OR THE SERVICES, EVEN IF AUDERE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Permission to use the Website may be terminated by Audere at any time in its sole discretion. Audere shall not be liable if for any reason all or any part of the Website is unavailable.

9. General

These Terms of Use, the Audere Privacy Policy and any other agreements incorporated by reference herein constitute the entire agreement between you and Audere with respect to the use of the Services. These Terms of Use and your use of the Website are governed by the laws of the State of Washington, without respect to its conflict of law principles. You expressly agree that exclusive jurisdiction for any dispute with Audere or in any way relating to your use of the Website, resides in the courts of the State of Washington and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Washington in connection with any such dispute. If any provision of these Terms of Use is found to be invalid or unenforceable by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition. 10. DMCA Notification

Audere reserves the right to remove any content or any other material or information available on or through the Website, at any time, for any reason. Audere otherwise complies with the provisions of the Digital Millennium Copyright Act (“DMCA”) applicable to internet service providers (17 U.S.C. § 512, as amended), and responds to clear notices of alleged copyright infringement. This section describes the procedure that should be followed to file a notification of alleged copyright infringement with Audere.
